Is there a statut of limitations on medical malpractice? My son was misdiagnosed with TB three years ago, he's only six now. It was rather tramatizing on him. He's more scared of X-rays than he is shots. That to me is really weird. I spent about $1000 on medicine. And the company is now billing me for about $2000 in medical bills, for a disease he never even had. Ok the skin test looked positive but it didn't feel positive there is supposed to be like a little rock under the skin. And the first x-ray he moved on but a good x-ray tech or doctor should be able to tell. The other 5 x-rays they took came out completely normal. We even had to take him to a specialist. But it was a long time ago and I can't afford a lawyer. If there isn't a time limit does anyone know a lawyer who takes payments or you only pay if you win type of thing in the san diego area? Or any other thoughts would be helpful. There has to be something... have you ever been told your 3 year old son was dieing, doctors need to be sure before they tell parents that.
Medical Malpractice? If a physician is convicted of medical malpractice, what is usually the punishment they will face as a result?
Would this constitute medical malpractice? This is a three part question: 1. Would a surgeon ordering physical therapy of a damaged limb before he/she knew the extent of the injury constitute medical malpractice? 2. Once a surgeon became aware of the seriousness of an injury would their continued ordering of physical therapy to that limb (which they knew could worsen the condition) constitute medical malpractice? 3. Would a surgeon's delaying corrective surgery by almost a year which could risk loss of use of the limb be considered medical malpractice? The injuries suggested here were the result of a traumatic accident in May. Initial x-rays showed only fractured of the shoulder after the shoulder had been "relocated". These x-rays were used as a basis for the ordering of p.t. Three months later, after extensive p.t was ordered, an MRI was ordered. The total results of the MRI were not revealed by the surgeon. The surgeon delayed addressing the extensive shoulder injury until weeks before his office stopped accepting my insurance. Eight months after the initial injury after a surgeon could be found that would address the injury the new surgeon shared that the rotator cuff was completely torn, the shoulder muscle was not attached and and a thread of a torn/tearing tendon is all that is attached to the upper arm. We were informed that surgery is imperative or risk permanent loss of use of the arm. Surgery is scheduled within the week.

Medical malpractice? I have been going to my Dr. for 3 years now and trust her completely. She has had me on Seroquel and Wellbutrin for 2 years and just decided to up my dosage of Wellbutrin (against my wishes). I didn't have a reason to raise the dose, she just said she wanted to. Well after 1 week of taking the higher dose I had a seizure (THANK GOODNESS I WASN"T DRIVING MY SON ANYWHERE!!!) I fell off a really high chair and broke my nose, lacerated it resulting in many stitches and a nasty (soon to be) scar and had a concussion. When I went in to see her after this event she said she knew she shouldn't have increased the dose with my past medical history of bulima (i guess the PDR says not to give to bulima patients) and she said that she also has had another pt. have a seizure at the higher dose too. and the PDR says that the higher dose has a high risk of seziures. Should I sue? I've racked up a lot of bills, had to drop out of school b/c of the concussion and missed 1 month of work.
medical malpractice??? I was sent home from the hospital yet again this morning at six am. The baby has dropped so far down now that every time I walk it feels like he is ripping my insides, My contractions are still two to three minutes apart lasting for 35 - 45 seconds, & my back feels so sore like someone took a two by four and hit me with it. The contractions are the worst part bc they are really, really painful. They don't want me to go back to the hospital until my water breaks! I was due on the 29th. Isn't this bad medical practice? I asked them about the doc breaking my water but he doesn't want to do it like other doctors, he wants to give me some weird thing called cytotec & insists that I take it instead bc he doesn't want to break my water due to he doesn't want to have to watch over me (he said he's busy even though there are seven maternity rooms at the ward and only two of them are in use and only one of them is his patient.) medical malpractice? My father is a diabetic. He has been on pills to control his diabetes for like 3 years. He has had the same diabetic doctor for the whole time. He has most of his toes cut off due to the diabetes. Yesterday, he almost went into a sugar coma when his sugar tested 394. He was given insulin to bring it down. I was told by the nurse, that he will have to take insulin for the rest of his life. She said he probably needed a long time ago. medical malpractice? my mom went into the hospital to fix a hernia and was discharged the same day. 3 days later she ended up back in the hospital because during the hernia surgery the Dr knicked her bowel. She then had a cholostomy done by a diffrent Dr from the same practice. 2 weeks ago the first Dr reversed the ostomy. Now she's back in the hospital because he didn't stich the intestines right and it leaked into her, and she has a cholostomy again. I think it's rediculous that one Dr operated on the same patint twice and managed to screw up both times. Bu what would you do if it was you who had to go through 4 operations because a Dr screwed up and knowing that you have another one ahead of you when that's all you want is for things to be normal again. they did explain the risks, but nothing was said about knicking the bowel or not stiching her up right. By the way as soon as this so called dr was done he went on vacation, I guess it's ok to comprimise patient care so the dr doesn't miss his plane. Also the cholostomy was done because they had o stich the bowel and it needed time to heal.
medical malpractice? I went into the hospital to have day surgery and the doctor made a mistake and ended up needing to repeat the surgery. He messed up again and needed to call in a different surgeon which had to perform emergency surgery to fix the other doctors' mistake because it punctured a pancreatic cyst and the acid ate through my pancreas. If the acid went on any other organ, I would have died. I was in the hospital for two weeks and was out of school for six weeks. I barely passed each class (I was a very good student before this) and now my GPA is so low (2.4), I am afraid I wont be able to get into a good school and be successful. What are my rights? The hospital preformed a surgery on my da Tuesday, they screwed up and admitted today that a Tech wasn't wathing monitors properly so they didn't open the shunt in time and my dad suffered in there words"catastrophic brain injury". Medical Malpractice? I have a girlfriend who had cosmetic surgery done about a year ago. Since that time her body has not properly healed and she's had two staph infections in relation to the surgery. Everytime she went back to her plastic surgeon he kept telling her that her pain and discomfort was normal, and only to find that a couple months later it was an infection that should have been treated. He was very unproffesional and at one point began to get aggressive with her when she kept going back to him because she felt ill. I know that when you get cosmetic surgery done, there are documents you sign and etc....she is looking to find an attorney to handle this case. When she had spoke to the nurse at this facility the nurse informed her that the surgeon no longer worked there and that she was not the first to complain about him. She also added that the particular procedure my friend had done was not one that this doctor had been particularly familiar with. Of course that could be heresay and anyway,,,,my big question is. Is she wasting her time? Should she just deal with the disfigurement she is left with or is the matter worth pursuing? I know it's possible nobody here is an expert on this subject but I was just giving it a shot, thinking maybe somebody has either been through this or knows someone who has. She has horrible results due to this procedure. I'd just hate to see her depressed and beating herself up for nothing if there isn't anything she can even do anway.

I think people should know that people like George Bush and the Republicans are trying to impose medical malpractice caps on lawsuits for pain and suffering of limits up to $250,000. These people defend this in the name of health care costs; meanwhile, there are many studies which show there is no correlation between med mal insurance and lawsuit caps. People should know there are over 100,000 deaths attributed to medical malpractice - let alone all the people maimed by careless doctors, yet Bush and the Republicans support this, as they claim to support freedom and justice around the word. I'd like to know where is the justice to those innocent victims and families facing heartache due to medical malpractice - certainly 250k will not do the job. I would be filing on behalf of the Estate of..., who is my mother. I am administrator of her estate. She was going to pursue this before but unfortunately she passed away before that happened. WI Medical Malpractice? Is it true that a medical malpractice lawsuit in the state of WI cannot be filed by family members who are not the spouse or minor child of the deceased? What if the spouse preceded the victim in death and the children are all well above the age 18? The following two factors played a direct role between the neglegent treatment and subsequent death: - Failure to provide appropriate treatment for a medical condition; - Unreasonable delay in treating a diagnosed medical condition; Is there anything else that can be done? Is no one to be held accountable? I understand that it may be difficult to prove a loss when not direct relation, but what if there IS direct relation...in this case the deceased's children over the age of 18 (all in their 40's and 50's). Wait - I just reread that answer and think I understand. I don't think monetary loss is what the family is claiming, but the wrongful death of a loved one is certainly worth taking some sort of action. Punitive damages or not, I'm having a hard time understanding why a suit cannot be filed by the family. Just so someone can be held responsible.

Texas Medical malpractice? I'm not sure if this would be cosidered malpractice or if we should just file a complaint and who to file it with. A doctor treating a patien for Bipolar disorder, anxiety, panic attacks, high blood pressure and diabetes. One of the medications for the anxiety and panic disorder is addictive. The patient goes in for his routine exam and refills and the next day realizes he was not given a refill on the panic disorder medication. The doctor is called and asked for a refill 4 days later after the patient has run out of the medication and experiancing severe side effects of withdrawl and panic disorder the doctor call the pharmacy and denies the refill and tells the pharmacy that he needs to see the patient. It states very clearly in all pharmacy information to NOT abruptly stop taking this medication due to extreme pschological and physical side effects of withdrawl. Is this malpractice or just somthing that should be reported to the medical board? If it should be reported then to whom and how to do so. This has caused severe panic attacks and phobia issues for the patient. The patient was seen two weeks ago by this doctor and requested refills on all medications, the doctor spoke of no concerns at that time and the patient is not seeking extra medication but a prescription that this doctor gave for the past three months. I am not speaking of a person taking exess of what was prescribed. The patient was not even aware of the possibility of addiction. The patient requested a refill a week prior to running out and has continued to request until this date which is of 5 days after running out a total 12 days before the doctor bothered to reply and decline the refill. And the doctor did not contact the patient he gave the information only to the pharmacy.

Medical malpractice statue of limitations...? I have a medical malpractice case but no lawyers want to look into it because the statue of limitations. I know I have a case, because many lawyers said they would have researched it if it was earlier but because i am 2 weeks away from the statue in DC they dont want to. I can not make myself believe there is no one that will help me or is willing to work with me. I know there are ways around it because in dc there is something that the statue may begin when there is knowledge of an error. I have also had 4 surgeries with the same doc for the same procedure so couldnt the lawyer begin the statue from one of the other surgeries and not the first one?? I can not make myself believe that there is nothing that can be done and i ahve to live the rest of my life in pain and the doctor doesnt have to lose 1 night of sleep over it...any advice??anybody? I didnt know that i really had a case or really knew of any statues...The kind of surgery i had requires 2 surgeries, 1 to place the device in your foot and one to take it out, in between i had 1 surgery a month after the first one to fix a screw that was incorrectly placed...I was hoping maybe the statue could begin from the 2nd surgery or even the 3rd?
medical malpractice? tubal ligation caused damage...? What do you think of this being worthy of a medical malpractice suit?: 2 years ago, I had a tubal ligation. I'm in my 20s, so the doctor only gave me the option to use steel clamps.(best success for reversal) A month after surgery, I experienced paralyzing pain in my lower abdomen. Went to the surgeon's office. his answer was "you just have pain due to the foreign objects in your system, here's a pain pill, it'll go away" Next month, same deal... They do an ultra sound. They can't find my right ovary. They switch to the ultra sound inserted vaginally. My ovary is found but displaced and fluid is present in my pelvic cavity. Diagnosis: "you likely had a cyst that ruptured and the 'explosion' displaced your ovary. Symptoms of cysts will disappear in 5-6 weeks. Your ovary will realign on it's own, here's pain pills" 2 years later, i just had surgery where we learned the clamp on the right was dangling, scraping up my insides and the resulting scar tissue bound my organs together.

Is it medical malpractice? Please help.? My dad has had a history of Liver problems, he went into the hospital due to neck pain and was givin a priscription of 500mg of vickodin. The doctors took blood and should have found that he had liver problems. They sent him on his way 3-4 days later he died. My understanding, people that has severe liver problems shouldn't be givin anything that has high doses of tylonol in it cause it will induce liver failure. After about 5 weeks the knee was much worse & the man goes to another doctor, this doctor orders test & it is found that the knee is injuried badly enough to require surgery. This new doctor asked why the ER never did Xrays & thinks that the injury would have heel with proper treatment (physical thepary) & if given proper rest (days/weeks off work) The new doctor states that the ER doctor neglected to do his job properly. Now this man thinks he has a medical malpractice case.

What is the difference between Medical Malpractice and Medical Negligence? My finance had some dental work done that the dentist completely screwed up. (A procedure that she was originally told was going to take 3 weeks is now in its 7th month, and we're making an emergency trip to another dentist this afternoon because something just broke.) I want to explore legal actions against her original dentist because of all the lost wages, time, and emotional & physical suffering she's experienced as a result of this -- not to mention the additional money that is coming out of our pockets to fix what he screwed up. Outcome Inevitable or Medical Malpractice? I went to a new OB Gyn on 6/15/2007 and was given a prescription for birth control, on 7/16/2007 I found I was pregnant. On 7/17/2007 I had a sonogram and was informed my pregnancy was ectopic, I was 6-8 weeks, and I was bleeding internally. I was sent to the emergency room where I had surgery and a portionof my right tube was removed along with the pregnancy. The doctor who gave me the prescription for birth control (ortho evra) did not bother giving me a pregnancy test only a pap smear. Would this constitute medical malpractice? This is a three part question: 1. Would a surgeon ordering physical therapy of a damaged limb before he/she knew the extent of the injury constitute medical malpractice? 2. Once a surgeon became aware of the seriousness of an injury would their continued ordering of physical therapy to that limb (which they knew could worsen the condition) constitute medical malpractice? 3. Would a surgeon's delaying corrective surgery by almost a year which could risk loss of use of the limb be considered medical malpractice? The injuries suggested here were the result of a traumatic accident in May. Initial x-rays showed only fractures of the shoulder after the (dislocated) shoulder had been "relocated". These x-rays were used as a basis for the ordering of p.t. Three months later, after extensive p.t was ordered, an MRI was ordered. The total results of the MRI were not revealed by the surgeon. The surgeon delayed addressing the extensive shoulder injury until weeks before his office stopped accepting my insurance. Eight months after the initial injury after a surgeon could be found that would address the injury the new surgeon shared that the rotator cuff was completely torn, the shoulder muscle was not attached and and a thread of a torn/tearing tendon is all that is attached to the upper arm. We were informed that surgery is imperative or risk permanent loss of use of the arm. Surgery is scheduled within the week.
What do you need to do to sue someone for medical malpractice? My grandmother just passed away from a massive stroke after having a tummy tuck done two days previous. They sent her home with a catheter still in and my grandfather was giving her blood thinners a day after the surgery she was still bleeding from the incision. We think that there was medical malpractice in this but we have no idea where to start to figure out if there really is a case or not.
