How long do I have to file a lawsuit for medical malpractice? In August of 95 (12 yrs ago), after more than 4 yrs of being misdiagnosed, docs rushed me into surgery to remove my appendix when I was only 6 years old.Since I was an infant my parents had taken me to numerous doctors being I had chronic UTI's and vomiting. They would claim it was gas or accuse my parents of abuse. Nobody ever did an ultrasound. When they finally went in to remove my appendix due to "appendicitis" they found a black, walnut size kidney and realized they had made a mistake. They stitched me up and told my parents to come back a few weeks later to have the dead kidney taken out. Along with the kidney they took out as much of the ureter tube as possible but left about 1/4 of it. Over the last few years I have been getting reoccuring infections and UTI's yet again. Yesterday I went to a urologist because I had intense back pain and he determined that because they left part of my ureter tube it became a sac of infection that now requires further surgery. Can I still sue?

My roomate has had at least six root canals, six crowns and twice in one year had the same tooth infected resulting in a trip to the hospital. Today she went to the same dentist she has always gone to because she felt like the infected tooth she had replaced with a crown had some discomfort and "tasted gross". Anyway the dentist told her that it was infected again and she would need a replacement crown because the old one allowed bacteria to harbor under the crown. She still owes $400 for the procedure done three months ago of removing the infected tooth, antibiotics for two weeks and a new crown, on the very same tooth that needs replaced now! she doesnt necessarily want to sue for anything more than the cost of getting the tooth fixed, hopefully for good this time because she doenst think she should have to pay for the same procedure again when it should have been done right in the first place. what do you think? Pregnancy/Delivery- medical malpractice lawsuit? Four years ago, at the age of 18, I gave birth to my son via Ceserean. Only after the doctors overseeing me had me attempt nearly 30 hours of labor and pushing. I had been diagnosed with pre-eclampsia- a pre-eclamptic woman should never deliver vaginally. A few days after my surgery, I was told I had fluid in my lungs, and had GREAT trouble breathing, however I wasn't given lasix to relieve the fluid. I was instead discharged, only to return to my doctor the next morning because my breathing and fluid retention had gotten so bad that I was coughing up blood stained sputum. I ended up being admitted and treated for congestive heart failure. My heart is still a little weak. And this condition may keep me from having more children- a great pain that hurts more than any of the rest. Since it has been 4 years, is it still late to sue for medical malpractice? This happened in Ohio. I had waited because I didn't think I had a case. and I was just grateful to be alive. -I had very high blood pressure when they induced me for labor. I should not have been pushing.

What if the spouse preceded the victim in death and the children are all well above the age 18? The following two factors played a direct role between the neglegent treatment and subsequent death: - Failure to provide appropriate treatment for a medical condition; - Unreasonable delay in treating a diagnosed medical condition; Is there anything else that can be done? Is no one to be held accountable? I understand that it may be difficult to prove a loss when not direct relation, but what if there IS direct relation...in this case the deceased's children over the age of 18 (all in their 40's and 50's). Wait - I just reread that answer and think I understand. I don't think monetary loss is what the family is claiming, but the wrongful death of a loved one is certainly worth taking some sort of action. My cousin, Kevin, has a medical malpractice lawsuit filed. His problem is that he is trying to find a lawyer.? He tried two *contingency fee lawyers and all that the first one did was order his medical records, but that lawyer made him wait for 8 months before the lawyer said that he was going to have a doctor evaluate them. Afterward, that lawyer simply told him that he couldn't find a doctor to evaluate the records. The second lawyer filed the lawsuit for him, but that lawyer also said that he planned to have a doctor look at Kevin's medical records. That lawyer never did and later withdrew as his lawyer. Its a shame that Kevin had to get two lawyers that weren't serious about wanting to help him. They both cited his especially young age of 23 as being the reason that they chose to not really help him very much. Is there any advice that you can give Kevin, short or paying for an out of pocket fee lawyer? Kevin is now paralyzed from the rib cage downward and he had a stroke. *-Both of the lawyers that he tried to work with would have only made a profit if the case were won. We submitted a petition to the court over a month ago for the court to appoint a pro bono attorney. The petition was denied, even though the Court Administrator was the one who suggested that I submit it. The local Bar Association and every service that offers local legal aid charges $100 per hour or more. I'm sorry, but I really dislike to see my brother being confined to home hospital bed, while he's still in his 20's and without a competent publicly funded lawyer able to help him. Whenever someone murders another person, they are allowed to have the court appoint them with a lawyer if they can not afford one. What kind of justice system turns its back on medical negligence victims, while even murderers get a fair chance to have a publicly funded lawyer convince a jury that they should be found innocent? What kind of backwards world do we live in here? We're going to probably be forced to submit a form formally withdrawing the lawsuit, for lack of a lawyer.

Does he have a medical malpractice lawsuit? We live in Kansas. A relative of mine, who is 29, recently beat cancer. He had sarcoma, bone cancer, in his knee. He ended up having a total knee replacement. In our small town, he was diagnosed as having low-grade sarcoma, meaning surgery would get the tumor. We then went to the nearest big city, where he was diagnosed by the surgeon as being mid-grade, meaning he would need chemo as well as surgery. The chemo gave him horrible side effects as well as made him permanently sterile. He almost died from the side effects because his throat swelled shut and he was SOOOOOO sick for 6 months. Turns out it was low-grade all along and removing the knee surgically got all the cancer. All that chemo was unnecessary. Does he have a malpractice lawsuit? It's been almost 2 years since the surgery.

Do I have a medical malpractice lawsuit? My boyfriend recently broke his leg which required surgery. He had no visible wounds and checked out fine after the surgery. When he went to the flow-up they said everything was great and changed the dressings and cast. However, for the following days after that he complained that the top of his foot hurt really bad and was going numb. He was able to get an appointment about 4 days later and when they removed the dressings there was a puncture wound about the size of a half dollar. He was told that a vein had ruptured and that it had done some nerve damage. They also said they weren't sure if he would ever have feeling there again. I think people should know that people like George Bush and the Republicans are trying to impose medical malpractice caps on lawsuits for pain and suffering of limits up to $250,000. Would healthcare prices in the US lower if people stopped suing for Medical Malpractice? It seems that in the US, healthcare is always an issue, especially the rising prices. However there are alot of Medical Malpractice suits where it seems that people are raking in millions, which I think would cause prices to go up, becuase someone has to pay for the lawsuits/insurance. In Canada I read it is very hard to prove, and I am sure in Cuba, or many other countries if a doctor messes up, then tough. Filing a lawsuit for medical malpractice? I want to file one on behalf of my mother's estate. I am 100% sure I have a case against them. The problem is money. I am forking over so much in probate that I am even coming out of pocket as executor to cover the estate so it makes it through the process. Estate money is tied up within the home. I have been searching for a lawyer. I got a response back from one but he charges a $100 consult fee. Now if I shop around at that price it could get pretty costly. I really don't want to resort to Ken Nugent so what can I do? I don't want to let these people get away with what they did but being in probate is difficult. I need to get things rolling though at least on one case because statute of limitations will become an issue soon. Should I sue for medical malpractice and/or wrongful death in the case of my one month-old daughter? She was diagnosed with a heart murmur during her first check-up. She was referred to a radiologist, who found two holes that hadn't closed right after birth (which happens in normal kids). Question about dental malpractice lawsuit? My previous dentist (in an HMO network) overprepared (removed too much tooth structure) two of my molars for a crown. The crown will not stay glued on because of it. I talked to a lawyer who said dental malpractice lawsuits are harder to prove than medical malpractice. medical malpractice? My father is a diabetic. He has been on pills to control his diabetes for like 3 years. He has had the same diabetic doctor for the whole time. He has most of his toes cut off due to the diabetes. Yesterday, he almost went into a sugar coma when his sugar tested 394. He was given insulin to bring it down. Medical malpractice- Should I file lawsuit? In 2005 I had surgery to fuse my vertebrae in my neck. It didn't "take", and I had to have a second one to attempt fusion again. This time through the back of my neck.It turns out that when the surgeon did the first one he misplaced one of the screws. I have to take morphine for the pain. The worst part about it is that when he went back in, he didn't repair the first mess-up even though it was obvious on the cat-scan I had prior to the surgery, which is what caused the first fusion to fail. Now I have to have a third operation to repair his obvious error, and it will happen next year. I plan to have a different doctor do it, for obvious reasons. I will most likely have this pain for the rest of my life. I am totally disabled now. I was hurt at work too. Would you file suit? Will I have to pay Worker's comp back? What qualifies as Medical Malpractice and should I look into filing a lawsuit? My mother fractured her skull on Jan7,08 and was in the hospital for over 2 months. She was unconscious most of that time and during got a blood infection from her pickline as well as from nurses not always using gloves. Also she still has a large bed sore on her bottom that was almost to the bone and is not healing well. I had to write a letter to the CEO of the hospital just to get the nurses to pay more attention to her. She was rarely turned and even sat in her own bowel movement for hours at a time when she was semiconscious, and had feces in her bed sore at times. She also was positive for MRSA in her lungs after getting a breathing tube. Has anyone else dealt with a situation like this and sought legal action? Is it worth it to talk to a lawyer?

Question Details: I had a baby 9months ago and seriously can't get over the horrible experience. I have never sued or brought legal action against anyone. It would take me alot more than this paragraph to explain the whole situation-but its very complicated with several different issues. Basicly as a result I feel like my life is ruined. I have a beautiful healthy baby but can't move past everything....I know i'm being vague but any referrals or assistance you can give would be great. Also if anyone knows if there are any online groups or boards w/other people seeking action against their Ob or MD i would love to speak to others. Part of the problem is the serious emotional distress that accompanied this whole mess-i'm actually ashamed to say i thought most people claiming this weren't being honest-but now see malpractice in a whole new light. I guess because our society is so "lawsuit" happy I had trouble allowing myself to truly believe that I was not treated correctly. Thanks so much.
i have a term paper to write over medical malpractice debating the topic. can anyone help me please? here's my intro: Medical malpractice is acclaimed to be one of the leading causes of death and injury in the U.S. to date. More people die from medical negligence than highway carwrecks. Should doctors get away with causing possible permanent damage to a patient and receive a mere "slap on the wrist" as punishment? Some sources claim doctors like to settle the lawsuit outside of the courtroom so that their names aren't tainted by the media with negative remarks that way they can continue business. Others claim it isn't negligence on the doctor's part but instead the patient's. using this can someone give me a better way of continuing my efforts in writing this paper?
