Is there a law to make doctor's hand over medical records? My husband was in a car accident. He was released to go back to work 5 months ago and the doctor's still won't turn over the medical records to our lawyer for the settlement proceedings. Medical malpractice? Deal with Doctor or consult a lawyer? My friend went in for 1/2 hour outpatient procedure. When she woke up it was over 24 hours later with major surgery. spent many days in icu and missed a lot of work. The doctor made a mistake somewhere along the line. She does not want to put the doctor through the ringer, she understands it was a mistake. She does want her medical bills taken care of and I told her to get a little more to help with a mortgage, couple hundred thousand, not millions. So the question is would it be better to deal with the (doctor, hospital) or talk to a lawyer who will want to get a settlement for millions so he can make a lot of money and drive up insurance costs?
During hernia removal surgery my husband's bladder was cut by doctor, is that medical negligence? surgery was supposed to last one hour at a local surgery center, he ended up going in an ambulance to a local hospital after a 6 hour surgery. doctor said he cut his bladder while trying to fix his hernia. he needed stiches to fix it and ended up hospitalized for 2 days and wearing a catheter for 20 days. How do I find a lawyer to put together a medical expert or doctor that can do a tissue biopsy? Most lawyers that I contact have said that I need to be suing someone first, for them to take the case. But since I don't have evidence (from the needed medical test) yet, how can I have someone to sue? I've also been told that the lawyer needs to reside in the state where the malpractice happened. If martial law broke out in the US, would it be better to be a doctor or lawyer? Because there's always going to be a need for medical persons, but if the court system comes to a halt and due to some unforeseen chaos martial law is implemented, than would it be better to be a doctor, as doctors can always have work as long as there are people. Lawyers can also work to restore the judicial system, but there would be less need than the amount of lawyers out there, so many would be out of work, while the demand for doctors would probably remain constant. medical malpractice , need advice , lawyer , doctors? i am currently hospetilize in one the memorial hospitals in FL and have a huge medical malpractice , i am here my 11th day with no result the first doctor i had tried to discharge me after 2 days without examine me and without seeing me even for 1 second and by being in the hall way, she also claimed i am to fat to fit the MRI machines ,and need to go somewhere else and mind you i did the MRI right in this hospital after we change a doctor . i would like to sue the hospital and that specific doctor for medical malpractice i feel neglected and a shame , i feel that the doctor was rude and there was many accidents on the way that i cant even discuss over the net i was admitted on the 07/07/09 and after the mess with the doctor they all of a sudden changed the admission date to 07/10/09 , i have paper show that i was admitted on the 07/07/09 if i could only can get hold of my chart with all the doctors notes you will sure see a huge medical malpractice going on and a big mass and cover ups i came here with severe headache and leg pain that i cant even stand on my legs dizzy , vominiting , and buttom line cant function at all i still cant barley walk and my headache stayed the same for 3 weeks already stabing pains and that not a migraine ...... the first neurologist that checked me was after 10 days i am here, i am getting pumped with 8mg morphine every 3 hours , Valium pills every 12 hours , and more pain killers just to knock me out. they want to discharge me tomorrow with pain killer and that all , they said that did all the testes and all looks good and they cant do nothing. i feel like they didn't do there job right and my main issue was the cover up they trying to do with the main doctor that was on the case that came to my room yelling in front of nurses about me lying and also while i was in pain in my legs she pushed on my legs on purpose to show that i am not in pain and that was in front of nurses my wife and a nurse in charge . mind you that a second befor a nurse tried to check my legs and she couldent even take the socks off my feet coz of the pain i asked her not to be in my room no more and asked to change the doctor and she kept on signing medication and audits for me . it took me overall 6 days to be able to change her out of my case . there is many complains on the same doctor from nurses and paitents. i would like to know if i have a case in this matter . . i feel neglected , i feel hurt , ashamed , i haven't eat at all or drink for More then a week after she said i am to fat for there machines , i am sure that allot of that is because i have no health insurance. or some wierd reason but i am still not healthy. p.s today after i complain about even more pain they increases the morphine dose to 10mg every 3 hours , i am woozy and feel bad i need your help i need justice. i am getting over all like 80mg morph every 24hours i am afraid i will be addicted to that after 11 days in here ..... they want to discharge me with no withrewl from the morph just kick me home. what shel i do the had me in the MRI , MRA , CT , even lumber pucter that the doctor pinch my leg nerv twice and it hurt till now. all test came clean and the final answer is they dont know what wrong and sending me home like this. help any one ? p.s. i am on heavy drugs now and int's 1 am sorry if it's hard to understand me for susan the nurse : " You are getting a lot of Morphine for your complaints of pains. Ive been to the police and got it logged they spoke to him, but could not charge him. I complained to his commanding officer they spoke to him, but did not discipline him. I got my lawyer to draft up a statement that he refused to sign saying that he "did nothing wrong" and he told my lawyer that he was going to complain about ME, because i was harrasing via solicitors letters, and that i threatned him the GMC. he reckons that he has spoke to the GMC and they told him not to worry? i should add, i was never his patient, is it worth bringing this to the GMC on the grounds that he brought his profession into disrepute? CORRUPT USA: schools, medical, court (lawyers, judges), cops, corporations, govt? Schools: Make a ton of money from taxes before college, changing area taxes from 300 to 3500. Then if you go to college, it cost a lot more unless you suck more money from taxpayers. Teachers the only ones getting the win win because they get a paycheck every week and the student just gets a piece of paper and might end up working at mcdonalds. Medial: Our doctors don't work as hard as other countries doctors and get paid wayyyy more, they whine it's because of health malpractice insurance, but blame the insurance and not the people you messed up on, I was in a hospital once and saw a nurse doing all the work and all the doctor did was walk in the room, look at a paper, and initial it and leave the room, i'm sure he gets paid way more than the nurse but did way less work. Court (lawyers, judges): I've seen a courtroom where a lawyer couldn't do his job in a proper manner, it's like a homeless person off the street can do this job. The judge will always favor against you. If you are against a cop in a us court, the judge will 100% favor the cop cause it's your word against his and your word don't mean crap against the cops word cause the state gotta make money. Cops: They wait at speed zone signs trying their best to give you a ticket. This weasel activity must be stopped. They really don't care about your well being, they just care about making money on you. I was in a 55mph zone and didn't speed and got pulled over for going 55 in a 35mph zone but the 35mph zone was 1/10th of a mile ahead. Corporations: I've seen math figures that sicken me. Corporate heads getting millions and millions leaving a company that has no money to begin with cause they're business is diminishing. It's like they get as much as they want and it don't matter what's right or wrong in the amount of what they get. Govt: for allowing all these functions before me to continue to be unfair to the middle class person. For overspending our tax dollars on garbage.

Workmans comp. taking to court to keep medical open. Is this the way to go or take a cash settlement only? Want to keep medical open but have heard that they will always say it is a new injury and workmans comp. won't pay it anyway. I went to do my taxes and I want to know if this is true: I had a medical procedure done, but it is consider plastic surgery..I can't report it. If the high cost of medical care is really due to high lawsuit costs, why aren't politicians addressing this? Nobody seems to ask WHY medical costs are so high, and why insurance costs so much. It looks to me that doctors pay through the nose for their own insurance due to ridiculous payouts on frivolous lawsuits and pass the cost on to us. Health Law Question: Who owns a patient's original medical records . . . the doctor or the patient? For example, let's say a podiatrist takes an in-office x-ray and the patient requests the x-ray film to keep for her personal file. Does the podiatrist have to give the patient the original x-ray, or is the patient entitled only to a copy of the x-ray? Another example, let's say that same podiatrist writes hand written notes in the patient file. Can the patient demand the original handwritten notes, or is s/he entitled only to receive a copy of those handwritten notes? I am trying to determine who actually owns original medical records, x-rays, MRIs, diagnostic films, patient charts, etc. in the medical/health field. I've read on here that some were able to unlock their records for medical reasons? Is that true? Does it take a Doctor to be able to do that? A lawyer? I I would think in those circumstances that a doctor or lawyer could facilitate to get that information if nothing else--even if the natural parents refused personal contact. It seems like 3rd party facilitated in the case of medical emergency would be a "safe" place to start for reform--and most really couldn't argue with it. It isn't great, but maybe a start that helps open the door.

CA work comp question to lawyers... Once a case is settled with future medical...? I thought that once a case is settled that I wouldn't have to put up the insurance company continuing to harrass me. They had all these years to do their discovery and object to my injury and treatment since 1999. Do I have to sign a medical information release now? My cousin, Kevin, has a medical malpractice lawsuit filed. His problem is that he is trying to find a lawyer.? He tried two *contingency fee lawyers and all that the first one did was order his medical records, but that lawyer made him wait for 8 months before the lawyer said that he was going to have a doctor evaluate them. Afterward, that lawyer simply told him that he couldn't find a doctor to evaluate the records. The second lawyer filed the lawsuit for him, but that lawyer also said that he planned to have a doctor look at Kevin's medical records. That lawyer never did and later withdrew as his lawyer. Its a shame that Kevin had to get two lawyers that weren't serious about wanting to help him. They both cited his especially young age of 23 as being the reason that they chose to not really help him very much. Is there any advice that you can give Kevin, short or paying for an out of pocket fee lawyer? Kevin is now paralyzed from the rib cage downward and he had a stroke. *-Both of the lawyers that he tried to work with would have only made a profit if the case were won. How do I get out of medical bill that was from a school incident? my daughter got stabbed in her eye with a sharpened pencil by some boy. She went to the emergency room the eye doctor and almost went to surgery. Now she is saying that eye goes blind for an hour at a time. Do most pro bono Lawyers do pro bono medical? I had my car totaled and have a neck injury from it that the insurance company won't pay for. I was not at fault the other driver was. I have a lawyer who wants my case, but it sounds too great. medical school and misdemeanor. dismissed vs dropped? I'm charged of disturbing the peace. the DA has offer 6 mth prob. and 10 hrs comm. service, but will still have to say yes to criminal offense. I want to sue a doctor for malpractice, can I sue him in civil court? How would I go about it? I had a breast lift with implants on 12/3/2007. It was a disaster! My right breast is way larger than the left. The left implant was put in wrong (a lot higher than the right). The left breast hangs substantially lower than the right one, and my breast are square! The stitches on my right breast came undone causing a 1 1/2" scar under the breast, which looks horrible. The right breast developed an infection, and when I went back to his office, he didn't know why the incision kept opening. so.... should i seek a medical lawyer? an issue with my spinal area. had an issue where a antenna fell on my back. I have medium to severe back pain consistantly. my first two doctos had xrays done that showed back conplications aswell as neck issues. however in the while of treatment from them civillian doctors i had another high ranking military doctor step in and say im malingering and told me as well as my chain of command told me that if i see the doctor that diagnosed me with these neck and spinal issues then they would recommend me for Uniform Code of Military Justice Jail time And/or departure from my service to the United States and the U.S. Army. Were you raised in an academicaly pushy household ? i.e parents who insisted you did well, monitored your progress at school, drew comparisons wtih you and other peoples kids, expressed dissapointment at under achieving in academics, mild appreciation of when you flourished... does this sound familiar ? If all of the above is applicable, tell me then, did you miss out a lot of stuff in your youth which you sacrificed in your pursuit for academic brilliance ? i.e lack of social life, partying, experimenting with drugs, late night beer fests, joining a band and trying to learn an instrument etc etc if this sounds like you, i wanna hear about it. peace out.
Should I also get any settlement or the Working Compensation Insurance would only pay for my medical bills? On my work-related injury that happened to my head and face, my case still open. Yet the hospital already sent me the bills during the treatment in E/R. Fortunately the Working Comp insurance adjuster said that the insurance will pay the bills, so I need to forward my med.bills to theirs. The adjuster even recommends me go to the nearest Medical Doctors from the lists he faxed me (total of 10 pages of the local family practices near me). However, though, my big concern is, would it be possible that I also can get some cash settlement.....at least to cover all of the extraordinary expenses related to my work injury? Can someone file a complaint/law-suit to a professor for causing severe emotional distress, and trauma which lead to spend money on doctors, loosing a job, and worst yet, being suspended by Univerisity. My friend has evidence: including medical doctors and psychologists records/letters. Not only has she lost ther financial aid money, but she most likely be looking at another university ( the school may not want her back).... She has recovered mostly from the trauma and has begun working, but this mess with this professor took all her energy, time, and money since she looked for help: therapy and medical assitance. She was diagnosed with depression and PTSD and physical conditions: intense migranes, back pain, and blood pressure problems. All of this arising from the incident she had with a professor...It is a long story, but I can tell you it was not her fault, nor she did anything that wrong to be expelled. And, we have to mentioned that the professor came out clean out this. I am Sorry... my grammar in this post is horrible! I forgot to edit it.
