Medical malpractice attorneys: Can a doctor put "Dictated but not read" on his reports? What would happen if a doctor put this disclaimer and then got sued for malpractice? By this statement I believe he means he takes no responsibility for any errors there may be--many are done overseas and are full of errors. Does this let him off the hook? Obviously it is not ethical because if the doctor doesn't take responsibility, who could, but what about the legal effect? Thanks for explaining any legal angles. I edit these things and just got curious. I also wonder what happens when a case goes to court and an insurance company is involved.
Any Medical Malpractice Attorneys out there? What do you think about this? A 19 Year Old Boy goes to the Doctor with a Cough and Chest Congestion he's Diagnosed with Bronchitis, given Steroid ihnaler and Antibiotic Prescriptions. 2 Days later he is have some Abdominal Pain, Vomiting and Diarreaha. He is then given a Cat Scan and Diagnosed with a Swollen Bladder, it was putting pressure on his Bowels and intestines. he is given a Cathiter and kept overnight. he is admitted at around 8:30 P.M at around 10 P.m he is given a Morhine Drip for pain he has an allergic reaction so he is given 2 Doses of Narcan his heart rate goes to 200 BPM he is given another grug to slow his heart it slows to 45 BPM at 4:07 A.M he dies of an Enlarged Heart. No Chest X-Rays were done until after his heart rate jumped so high, only then did they see the Enlarged Heart. This young man Graduated from High School 2 Years Ago. And played Football and Wrestling all 4 Years. He did start smoking Cigarettes and Marijuana After High School. That is it in a NutShell, What do you think?

Does anyone know a good Medical Malpractice Attorney? Must be in TN or a contiguous state? I currently represent myself (pro se) to preserve my rights but I am not an attorney. I suffered a closed-head injury to the hypothalamus that went undiscovered and the symptoms ignored by Drs when presented. Drs. never evaluated and head, spine , c-spine after traumatic high speed crash. They only treated obvious injuries, i.e. ruptured achilles heel, ruptured hamstrings complete destruction of quadriceps, complete destruction of gluteas maximus muscle, complete separation of sciatic nerves from spine and significant, obvious from CT Scan, frontal impact damage to brain. previous to this accident I weighed 172 lbs and now weigh 96 lbs and continue to have difficulty keeping food/water down, extreme homeostatic temperature changes varies from 89.4 to 104.7, I need help that is beyond my reach. Accident happened 5/5/05 and I need all the help I can get. I do not qualify for Tn Asst. because I am white, single ,have no dependants a category for my position does not exist. Help PLZ
I need a good medical malpractice attorney in Phoenix.? I had bloodwork done in December of '06. My TSH (thyroid) was so out of whack I could have died. I discovered this when I went for pre-op testing recently. My thyroid was even worse and surgery had to be canceled. I was born in 1958 and exposed to a drug which originally marketed under the the name Thalidamide,but was administered in this country as Kevadon.It caused me to be born with a birth defect to my hands.I was told that there is a law firm that has a list of the doctors who prescibed the medication to women who were experiencing morning sickness while pregnant.Unfortunately for me the hospital I was born in (Provident-Baltimore City)destroyed all records.Although I'm now 49 yrs old I'm still experiencing problems.There also seems to be the matter of the statue of limitations.But I wouldn't have known about the drug Kevadon if it were not for my research into the drug Thalimide which was not suppose to be marketed in this country.I have no medical insurance to help me seek the medical attention I need with the current problems I'm having with my right hand.Do I have any way to compensated?Please if there's anyone who can help me let me know.
Medical Malpractice? I have a girlfriend who had cosmetic surgery done about a year ago. Since that time her body has not properly healed and she's had two staph infections in relation to the surgery. Everytime she went back to her plastic surgeon he kept telling her that her pain and discomfort was normal, and only to find that a couple months later it was an infection that should have been treated. He was very unproffesional and at one point began to get aggressive with her when she kept going back to him because she felt ill. I know that when you get cosmetic surgery done, there are documents you sign and etc....she is looking to find an attorney to handle this case. When she had spoke to the nurse at this facility the nurse informed her that the surgeon no longer worked there and that she was not the first to complain about him. She also added that the particular procedure my friend had done was not one that this doctor had been particularly familiar with. Of course that could be heresay and anyway,,,,my big question is. Is she wasting her time? Should she just deal with the disfigurement she is left with or is the matter worth pursuing? I know it's possible nobody here is an expert on this subject but I was just giving it a shot, thinking maybe somebody has either been through this or knows someone who has. She has horrible results due to this procedure. I'd just hate to see her depressed and beating herself up for nothing if there isn't anything she can even do anway.
Has anybody ever sued the USAF for medical malpractice and could share some advice? I am currently in the USAF and I know that I cant sue the USAF but the medical issue is with my wife and as a civilian I believe that she sue on her own behalf but I an not 100% sure. Medical Malpractice- do I have a case? Or go for 2nd opinion first? Ok- in May of 2006, I had a ruptured ectopic pregnancy, which the Dr. removed surgically, along with my fallopian tube. He had gone through my previous c-section scar (2 yrs. previous), and opened it completely. Every time I went to him, I told him I felt that it was not healing correctly. He said "put powder on it". After about 5 follow up visits, I stopped going to see him. I owed $$ from the surgery (I do have insurance), and he wouldn't see me for my last follow-up unless I paid the balance in full. My scar has STILL not healed completely- it oozes, gets infected, clears up, and gets infected again. I finally made another appointment with a different Dr., but now my husband says I should see a malpractice attorney first, because the new Dr. is not going to admit that the other Dr. did something wrong. The only reason I'm even considering this is because I have a feeling that I will have to get cut open again, and then I'll have to miss work and be responsible for more med bills.

I am looking for a medical malpractice attorney on a contingency basis.(meaning, I owe nothing if they do not recover) I am desperately seeking help. my son who is a minor, had been very ill since dec. 2005 it all started when after he would eat, about 20 mins later he would vomit. it at times was so forceful that there was blood. took him to my family physician who ran tests for ulcers and found none. also ran an upper GI and said that there was a possiable malrotation of his stomach. he then refered us to a gastorenteroligist, he ran all sorts of blood tests, he looked at the upper Gi report and told us that my son did infact have a slight malrotation of his stomach. and did a solid phase empting study that showed a delay of 6hours for the stomach to empty. he also did endoscopy ( scope) and found that the bottom muscle was incompetint. he was diagnosed w/ gastroparisis. he worsend severly , taken to childrens hosp. it was total misdiagnosis it was gullbladder diease.

is there a statual limitation on a minor for medical malpractice lawsuit in Missouri? my son's doctor accidently disceted the main artery in his heart when he was three. he has been on the list for a heart transplant and is now 12 years old. i hired an attorney and then later fired that attorney because i didnt think he had our best interest at heart, the case was dismissed without prejudice. now my son lives with his father and his father does not want to persue the case for him. can he hire a new attorney when he is 18 = or will his limitations run out?

I had eye surgery at Kaiser and I look like a freak my eye is 97% red all of the time and it looks like a ball of jelly. The surger was to straighten a crooked eye that I was born with it's technically called strabismis, my eye is still crooked but now instead of it going toward the left it's crooked towards the right. Then day after the surgery my eye was infected. I went back the surgeon said that it was normal and just healing well I wasn’t in a normal amount of pain so I got a second opinion & that doctor said something 2 the fact that it’s 2 soon 2 tell because she couldn’t see past the scaring tissue. I sought the advise of an attorney in SF he asked me 2 send pictures and a copy of my medical records,I did. He sent me a letter saying that he wouldn’t take my case (no time) he advised me about the SOL & told me 2 keep looking for an attorny. The SOL passed, is there anything that I can do?

I am trying to find out if anyone knows of a successful wrongful death suit where the victim has received a settlement from one of the doctors involved for medical malpractice. However, the hospital and others involved were not sued. I would like to know because in 2000 my father was a victim of medical malpractice and I have documented evidence that the cause of his death is directly attributable to the initial medical malpractice. I have spoken to a few attorney but they have all been less than helpful perhaps they view this case as one that will require some major effort so they are balking. Do I have a case of malpractice against my doctor? I was having surgery and while the they were administering the anestesia they messed up my jaw. Firstly, I am not an advocate of litigation, but I feel if this is going to cause me pain or inconvienience for the rest of my life then that is worth some compensation. I've had X-rays and my oral surgeon has ordered an MRI for tomorrow, so I'll find out then our next course of action. From the first maxofaciallary doctor I talked to (who said this was out of his area of expertise and couldn't help me...referring me to my current dr) it seemed like this was going to take a lot of therapy and after that entail wearing a biteplate for months! This, along with the pain, make me think someone should be liable.
what if we can do if we suspect Medical malpractice? I literally believe this is a matter of life or death!! My aunt is suffering from a serious staph infection in her heart due to dirty utensils used in surgery last year. The hospital itself admitted to this, but since their son (power of attorney) was not aware of what this actually meant he did not thin twice. Can anyone point me to childbirth data showing women of c-sections that have died after childbirth...? and the child lived. i.e. determined that internal bleeding was the cause. Case: A 27 year old otherwise healthy woman who has given birth 2 other times without complications was said to have internal bleeding and never came to. Then experiencing renal failure and 30 pints of blood to be used. Any suggestions where this may be medical malpractice would also be appreciated. The child was born without complications and is doing fine. Further, anyone knowing of any GOOD medical malpractice attorneys in the Dallas/Fort Worth areas that are board certified and this is their only line of practice would be appreciated.

I went to the same OBGYN for months, and I keppt telling him something was wrong, and I told him that I was having problems urinating, and he tested my urine and told me that I had high protien in my urine, and he kept telling me that my baby was not gaining enough wait, what was wrong was I had a condition called toxcemmea, but he never diagnosed it, in fact it was not diagnosed until I finally sought a 2nd opinion, the day I went to see the 2nd OBGYN, I was severely sick, as I had been for some time, as my other OB had seen me, anyhow, the day I saw the 2nd doctor, I was hospitallized, and I ended up developing another condition called HELLP syndrome, then I hd a brain annurism, none of this would have happened had my 1st OB diagnosed me with preclampsia to began with, and I was able to diagnose it once looking it up on Web MD. Concerning the malpractice case, yes I contacted a malpractice attorney and they jumped all over it? I had stacks of medical records with verified wrong doing and negilence. I had pictures of what had taken place. The attorneys were positivally going to go after the doctors who did this. They wanted to gather the evedence and build their case while the patient was healing to a point as to the best that they ever would and then they would file the case. The patient died shortly before the case was filed. I contacted the attorney to anounce the death and he told me that it was over. I ask him what he ment that it was over, this person lost thier life because of the doctors negilence and you tell me that it is over. He said that it was an economic issue now and that there wasn't any money to go after now and that he had million dollar cases on his desk to work on. He declined the case. I presented the medical records to three other malpractice attorneys who jumped on it only to later decline it as an economic issue. the patients long term care & pain & suffering was gone
How can I get a debtor to stop calling? My son recently had emergency surgery and the medical bills are absolutely enormous (in excess of $86000 AFTER insurance pay outs). Is This Medical Malpractice? Doctors in the ER took Xrays that night and sent my fiancee home without a collar or anything. 3 days later they call and say "Well, we think you have a broken neck, come in for a collar." Then for the next 2 years he has severe pain shooting through his arms and legs and they act as if he is crazy and actually told him he had everything from "Fibromayalgia" to "Post Traumatic Stress Disorder" everything but what was really wrong in the first place. We were jerked around for about 2 years. They actually refused to give him medication for pain when he needed it. Until one day he collapses and seeks treament somewhere else. The new docs said that the whole thing stemmed from his broken neck not healing properly causing him nerve damage and the result of pending surgery for it. He now has a paralyzed hand and pending surgery that he should have had immediately after the accident. I want your opinion. If you are a doctor or attorney please state that in your answer. I have never sued anyone in my life. I am not a sue-monger. We have documented evidence to show he was not treated properly. We are not out to ruin anyone's life by suing them. This hospital also has had other cases where neglect resulted in death or young and old. There was no disclaimer on the release papers that said anything about "Doctors not being radialogists" Even so, the new doc we are seeing said by looking at the current X-ray that a child could have seen this break. If he would have moved the wrong way in the three days he went without a collar he could have been paralyzed from the neck down.
What kind of attorney do I need to hire for health insurance problems? I have been paying for Cobra for myself, my wife and baby girl. It isn't cheap. I have been having extreme difficulty filling prescriptions and it is medication I can't stop taking. We are in good standing with our payments. However, when I try and fill my prescriptions, my pharmacy tells me my insurance is terminated. Question about dental malpractice lawsuit? My previous dentist (in an HMO network) overprepared (removed too much tooth structure) two of my molars for a crown. The crown will not stay glued on because of it. I talked to a lawyer who said dental malpractice lawsuits are harder to prove than medical malpractice. He said the cost of the lawsuit would exceed the cost of getting it fixed. Are there any non profit attorneys that would help me sue if I can't pay the legal fees? I want to have my previous dentist pay to get my tooth fixed by the specialist. I have to go through painful oral surgery (crown lengthening) to get the crowns to stay glued on. Epilepsy and haladol. Do we have a case? My mom is epileptic and has frontal lobe seizures. She was hospitalized last week with stomach problems last week. The whole time she was in the hospital, she was having seizures and nobody was doing anything about it. Frontal lobe seizures cause erratic behavior and to make a long story short, my mom was restrained and given Haladol in her IV while having a seizure. Haladol is an anti-psychotic medication that has specific warnings against giving to people with epilepsy. My mom is now unresponsive and in the ICU. I live in Dallas and my family is in San Antonio, I'm heading down there tomorrow. I was thinking of contacting a medical malpractice attorney because the negligence on the hospitals behalf caused my mom to be in the state she's in!! Does it sound like we possibly have a case
Medical Malpractice? Ok so here is the short version.... The hospital preformed a surgery on my da Tuesday, they screwed up and admitted today that a Tech wasn't wathing monitors properly so they didn't open the shunt in time and my dad suffered in there words"catastrophic brain injury". We spoke to Risk management today also. They are fully admitting it's there fault.....so question is...hire an attorney NOW or wait til he is hopefully stable. A retires attorney told me to wait...get more info from the hospital while they are talking. We have 2 years in our state to file. We actually retained an attorney before I spoke to this other one who said she would get started now!! We have 3 days to cancel her so what do you think???? We don't want to piss off the hospital while dad is still unstable. I Excuse my spelling I'm tired and stressed...I really question whether he will survive this. It's really bad... Is it malpractice, criminal or some other type of suit when a Doctor tampers with medical info? A medical doctor, who never examine me, was hired by the SSA Disability Administration to review my medical records, submit a written report of my medical conditions, tests, surgerys, and either approve or deny my claim for Disabilty Ins. The Dr.completely falsified the info, added info that is non-existent, in order to deny my claim. It is not a mistake here or there, but the whole report. He violated my constititional rights, caused an unfair denials & Hearing, caused me to lose everthing, suffer physically, emotionally, and has slandered me as a fake. I can absolutely prove this. My former attorney withheld his knowledge of this. Unhappy, I questioned him on some things, he dropped my case, sent his file; in it the false review, dated over year before I finally got a hearing! Even though this involves a Social Security Disability Case, my new disabitlity attorney informs me that I cannot even appeal my case based on this & is appealing on another procedure error. Has anyone spent anytime in a hospital lately? Is it just me or has our Health Care system went to crap? I have been sent to 4 different hospitals in the past 3 weeks due to complications in my pregnancy that should have been caught by my original OBGYN immediately when I told him my symptoms, instead, because my blood pressure didn't read high he didn't even test me and to make a long story short I ended up having a mild brain annurism due to his incompetency, anyone know any good attorneys for medical malpractice?
