Looking for an attorney who specializes in medical malpractice cases involving drug companies? I was born in 1958 and exposed to a drug which originally marketed under the the name Thalidamide, but was administered in this country as Kevadon. It caused me to be born with a birth defect to my hands.I was told that there is a law firm that has a list of the doctors who prescibed the medication to women who were experiencing morning sickness while pregnant.Unfortunately for me the hospital I was born in (Provident-Baltimore City)destroyed all records.Although I'm now 49 yrs old I'm still experiencing problems. There also seems to be the matter of the statue of limitations. But I wouldn't have known about the drug Kevadon if it were not for my research into the drug Thalimide which was not suppose to be marketed in this country.I have no medical insurance to help me seek the medical attention I need with the current problems I'm having with my right hand.Do I have any way to compensated? Please if there's anyone who can help me let me know.
Medical Malpractice cases? Well for school I need to research real medical malpractice cases. Like surgeries gone wrong or doctors prescribing wrong pills to the wrong people. The only good case I have is where the Las Vegas clinic might have given Hep c and other stds to like 40,000 patients. But personal experiences would be good too. Thank you for your time.
medical malpractice? my mom went to a lawyer about a medical malpractice case, The lawyer went over all the medical records as did a Dr, and they came to the conclusion she in fact has a case. What is the average length of time to settle a malpractice case. This is in the state of Mass if that matters
How much money should a person ask for in a medical malpractice case.? Well a friend of mine had a knee replacement about five years ago it just started to hurt really bad medical attention was given only to find a foregin object in the joint space of the knee. How do you begin calculation on something this terrible. And the object is still in the knee, after five years waiting to be removed
Why do people think we should do away with medical malpractice? 1) Doctors make mistakes all the time. Should they not be held accountable for their mistakes? 2) Malpractice cases are RARELY won by patients. 3) Malpractice cases account for a very small percentage of overall health care costs in this country. Why do people look at Malpractice cases as being the problem with medical care in this country? Do you think the health care lobbyists in Washington, D.C. have something to do with this? Do you think that Doctors should not be held accountable for the mistakes that they make?
How to solve the medical malpractice case? I need your excellent opinion and good informations. I have a problem to be solved immediately. I am 23 years old woman. never married, no experience in sexual intercourse, physically virgin. Perfectly healthy before this happen. 7 weeks ago, I felt pain in lower back and went to the pain clinic and consulted doctor. After consultation he gave me injections in my lower spine. It was about 5 o'clock in the afternoon. After that, I came home and slept but awakened by severe pain in my belly (the abdomen) 3 o'clock in the next morning. I called 911 and went to emergency room in hospital. They checked and told me there was a lot of blood in the belly and need immediate operation. Operations done immediately and taken about two and half hours and they got rid of blood about 700 ml. I was given two bags of blood transfusion during operation. They cut the velly about 15cm and I have a scar now. After operation, Doctor told me it was corpus luteum rupture. After leaving hospital, I went to the pain clinic and met the doctor who treated me and asked about the medicine which I had been injected 7 weeks ago. But doctor said it was only a coincidence and he did nothing wrong and refused more explanation and rejected giving me the document of medical diagnosis and treatment (medical chart). I asked him if he use the a hormone drug in injection and he said he never used a hormone drug in my treatment. And he just gave me a simple memo instead of full copy of chart. Contents of memo was " Lidocaine 5ml " only. Therefore I met the chief of hospital and he issued the document. Document of medical chart said as follows. 1) Triamcinolone 40 mg/ml (1ml) 1 vial * 1 1 EPI 2) 2% Lidocaine 400mg/20ml (20ml) 1 vial * 1 1 EPI I known that the doctor lied me about using of hormone drug and dosages. He even lied me about the volume of medicine. In fact, I can not believe the credibility of the issued copy of document which issued by the chief of hospital. I have heard that hormon medicine like triamcinolone have big side effects to blood vessels. I think It affected seriously in rupture of the corpus luteum. I also so worry about relapse of this thing and any harm to the pregnancy in the future. But, I have not much informations about hormone medicine and informations in internet and guidebook in pharmaceutical company are superficial and can not understand. Hospital said that I must present them medical evidence about correlations with the use of triamcinolone and rupture of the corpus luteum. They refused talk. Please inform me of any opinion and idea to solve this problem. (1) Correlation with the use of triamcinolone and corpus luteum rupture (2) Side effect of triamcinolone (3) Any medical thesis or journal or report relevant to this case (4) Possibility of maltreatment during injection to spine (ovary exists near front of injection point) (5) How to find out this relevant source material or informations (6) How to handle this case (legal point or strategy) I fully sincerely appreciate you in advance. Thank you so much your long attention. Laura LAURAPALTON @YAHOO.COM
Medical Malpractice Help Needed? I need to find information on old medical malpractice cases, any that have already been settled. If you can suggest a good form of resource from the internet or from a book that I can find in the library, I would greatly appreciate it.
how do I find out if my dr has ever had a medical malpractice case? It is not because I don't trust my dr. There was a dr from where I live that has a really reason for malpractice suit and since I just found out I was going to have another baby I wanted to make sure that my OB does not have alot of suit againt him. I love my OB, he did a great job with my last 2 children. I also work in the medical filed before I became a stay at home mom so I know all about unhappy people and suit for no real reason. But it is my right to find out about my OB and I wanted to make sure. Nothing wrong with that :-)
what determines medical malpractice & does this man really have case? He was in a car accident & suffered a knee injury. He was sent to the ER via the ambulance. When there he told the doctor about the knee injury but the doctor never did any X-rays claiming the guy was too healthy. The doctor said that the knee would be sore but would heel in a few weeks & that the man can return to work the next day. After about 5 weeks the knee was much worse & the man goes to another doctor, this doctor orders test & it is found that the knee is injuried badly enough to require surgery. This new doctor asked why the ER never did Xrays & thinks that the injury would have heel with proper treatment (physical thepary) & if given proper rest (days/weeks off work) The new doctor states that the ER doctor neglected to do his job properly. Now this man thinks he has a medical malpractice case.
Do i have a case for medical malpractice? I went into a local walk in clinic where i told them i was having a sharp pain when i breathed. They did some stuff and told me it was probrobly just a pulled muscle and to call if it got worse. I had to make them do an x ray b/c they thought it wasnt serious but i knew i was in a lot of pain. So in the next week the sharp pain got worse and i called them and they said the doctor would call me back. Never got a call back and about 2 weeks later bairly being able to walk i went to the emergency room where i was told i had the worse case of phnemonia they had seen in ten years and had surgery and now have a scar larger then a ruler on my right side of my back and had to get a blood transfusion during surgery.
Is this a medical malpractice case? My 13 year old son fell down the dtairs last night, and injured his foot, he couldn'r put pressure on it, and now used vrutches that we had from before...my wife called 911 and they told him to stay put until they got there. The doctor at hospital took xray's, came to see my son, said rudely, "There's no reason to have to call emergency 911 resue for something like this, I wouldn't recommend doing it again, if it's not necessary, save it for the people who really need it." As he said he was going to look at the xray's and be back, my wife saw him go to his desk, but didn't look at naything, talked to a nurse, and game back saying, "well, I don't think there's anything majorly wrong with his foot, it's probobly just a sprain, can he put pressure on it?" Our son got up and slowly put pressure on it, and walked with a hobble, and painful limp. He didn't give him any pain medication, or splint, cast, or even an ace wrap, and sent him home. should we have a lawsuite here?
need to find a medical expert witness for medical malpractice case? urologist removed kidneystone caused a bleeder, left on vacation, patient in severe pain, later finds out patient has nerve damage on same side of bleeder.Told by urologists partner "protocol says we have to stop the bleeding in 2 days if it does not stop on its own."Patient was then given 6 units of blood.Nine days later patient bursted open blood everywhere and a radiologist had to be called in to stop bleeding. As a result a coil was left in kidney.Day 12 urologist comes back from vacation and tells patient"when the radiologist went in to stop the bleeding a coil popped off and if you don't have it taken care of you will be right back where you started."
What should I wear to my Medical Malpractice case? I'm going to court in a few weeks and I'm not sure what to wear. This is actually a repeat thing, we appealed the last verdict and when it went to Florida Supreme Court, we won a new trial. I'm a stay at home mom and have always been one, so I don't want to dress too nice b/c that just isn't me, but I want to respect the court and dress right. The trial is going to be 3-5 days long, so I gotta come up with a few outfits. The other "problem" is that we moved to another state, so we have to travel & I cannot take all of my stuff with me. It has to be planned out and packed and ready to go. I'm thinking nice skinny jeans with baby doll tops (nice ones) and Mary Jane's as shoes. What about leggings? (The baby doll tops go past my butt, hiney, back-end). I don't wear heels & haven't for 15 years, so it'll pretty much have to be my Mary Jane's. I'm not trying to be anyone else but me, dressing up or dressing down for court & the jury. I'm just worried about it being "dressed down".
What do you need to do to sue someone for medical malpractice? My grandmother just passed away from a massive stroke after having a tummy tuck done two days previous. They sent her home with a catheter still in and my grandfather was giving her blood thinners a day after the surgery she was still bleeding from the incision. We think that there was medical malpractice in this but we have no idea where to start to figure out if there really is a case or not. Please give us some idea on where to start and how to really know if there is a case to pursue. Thank you.
medical malpractice? Ok so i my b/f (we'll call him bob) has a medical case that he believes is worth taking to a court room. this is the what happen when he was 17 on of his testicals became swollen so he went to the doctor and they gave him a medication for it but it was the wrong medication that caused it become even more swollen he went back to the doctors and they gave him another medication that brought the swelling down but now his testical is 2 times smaller the the other and has possibly became sterile because of it also it happened about 4 years ago we want to know if he was to take it to the court room if he would have a fighting chance? well i found out that when he went back to the doctors and the doctor at the time told him point blank that he had given him the wrong medication
Do I have a case of malpractice against my doctor? I was having surgery and while the they were administering the anestesia they messed up my jaw. Now I can only open my mouth half way and it looks like I'm going to have to have surgery to correct it. Do I have a case of medical malpractice? How do I choose a legit attorney to ask? Thanks! Firstly, I am not an advocate of litigation, but I feel if this is going to cause me pain or inconvienience for the rest of my life then that is worth some compensation. I've had X-rays and my oral surgeon has ordered an MRI for tomorrow, so I'll find out then our next course of action. From the first maxofaciallary doctor I talked to (who said this was out of his area of expertise and couldn't help me...referring me to my current dr) it seemed like this was going to take a lot of therapy and after that entail wearing a biteplate for months! This, along with the pain, make me think someone should be liable.
Do I have a case; medical malpractice? Left arm was fractured in 4 places and dislocated at elbow. Doctor had set the bones improperly causing the need for more surgery and permanent deformation as well as limited use. These problems will persist for the rest of my life. The matter happened awhile ago, but was never resolved. I'm currently suffering from tendinitis and the inability to work. If I can take some legal action, where do I start? The doctor casted the arm before the swelling went down. This led to the bones slipping back out of the joint which required them to cut it open a second time. This doctor is well known for making blunders often.

Would a medical malpractice lawsuit be procedural law? I am confused on the difference between substantive and procedural law - I know that substantive is what gives rights/responsibilities and procedural is how a case is handled. But which would a medical malpractice lawsuit be?

Outcome Inevitable or Medical Malpractice? I went to a new OB Gyn on 6/15/2007 and was given a prescription for birth control, on 7/16/2007 I found I was pregnant. On 7/17/2007 I had a sonogram and was informed my pregnancy was ectopic, I was 6-8 weeks, and I was bleeding internally. I was sent to the emergency room where I had surgery and a portionof my right tube was removed along with the pregnancy. The doctor who gave me the prescription for birth control (ortho evra) did not bother giving me a pregnancy test only a pap smear. Had the doctor diagnosed me four weeks prior could the surgery have been avoided? Do I have a case for medical malpractice?

I am 16 years old turning 17. i cared about my kid i was in the hospital for 5 days i almost died if they would of gave me and ultrasound i would of never lost an ovary i would of never had to spend 5 days in the hospital if they would of just looked i still would of lost my kid regardless and i wouldnt of had to go through all the pain im going through i had to get 5 bags of blood pumped into me.i didnt have no pulse i couldnt breath on my own i was practicly dieing. i would of never been through all of this if they gave me the ultrasound like they said they would i told them i couldnt hold food down and i got alot of cramps. and please dont judge me for my age because people do make mistakes nobody in the world is perfect.
Medical malpractice statue of limitations...? I have a medical malpractice case but no lawyers want to look into it because the statue of limitations. I know I have a case, because many lawyers said they would have researched it if it was earlier but because i am 2 weeks away from the statue in DC they dont want to. I can not make myself believe there is no one that will help me or is willing to work with me. I know there are ways around it because in dc there is something that the statue may begin when there is knowledge of an error. I have also had 4 surgeries with the same doc for the same procedure so couldnt the lawyer begin the statue from one of the other surgeries and not the first one?? I can not make myself believe that there is nothing that can be done and i ahve to live the rest of my life in pain and the doctor doesnt have to lose 1 night of sleep over it...any advice??anybody? I didnt know that i really had a case or really knew of any statues...The kind of surgery i had requires 2 surgeries, 1 to place the device in your foot and one to take it out, in between i had 1 surgery a month after the first one to fix a screw that was incorrectly placed...I was hoping maybe the statue could begin from the 2nd surgery or even the 3rd?
Has anybody ever sued the USAF for medical malpractice and could share some advice? I am currently in the USAF and I know that I cant sue the USAF but the medical issue is with my wife and as a civilian I believe that she sue on her own behalf but I an not 100% sure. Also, unsure of the process (I would assume that we would have to find an attorney that specializes in these types of cases). Any guidance would be helpful. Thanks
How does a person deal with medical malpractice involving the VA hospitals? It seems that the VA is such a powerful institution that few lawyers have the resources or will to deal with their arrogance. This seems especially the case during times of foreign policy crisis such as now. But, I have a serious need to resolve the prolonged problems that I am having with these people.
How are medical malpractice awards determined ? Specifically in California, how does the attorney determine how much to sue for? Does anyone know the outcome of cases of improper administration of Kenalog resulting in subcutaneous atrophy? Assuming the case does not go to trial, how does the physician's insurance company come up with a counter offer to settle? Thanks!
medical malpractice? My father is a diabetic. He has been on pills to control his diabetes for like 3 years. He has had the same diabetic doctor for the whole time. He has most of his toes cut off due to the diabetes. Yesterday, he almost went into a sugar coma when his sugar tested 394. He was given insulin to bring it down. I was told by the nurse, that he will have to take insulin for the rest of his life. She said he probably needed a long time ago. She said that if he would have been given it before, he would probably have all his toes. I am thinking of pursing a lawsuit against his doctor. Do you think that I have a case?
Medical Malpractice? I have a girlfriend who had cosmetic surgery done about a year ago. Since that time her body has not properly healed and she's had two staph infections in relation to the surgery. Everytime she went back to her plastic surgeon he kept telling her that her pain and discomfort was normal, and only to find that a couple months later it was an infection that should have been treated. He was very unproffesional and at one point began to get aggressive with her when she kept going back to him because she felt ill. I know that when you get cosmetic surgery done, there are documents you sign and etc....she is looking to find an attorney to handle this case. When she had spoke to the nurse at this facility the nurse informed her that the surgeon no longer worked there and that she was not the first to complain about him. She also added that the particular procedure my friend had done was not one that this doctor had been particularly familiar with. Of course that could be heresay and anyway,,,,my big question is. Is she wasting her time? Should she just deal with the disfigurement she is left with or is the matter worth pursuing? I know it's possible nobody here is an expert on this subject but I was just giving it a shot, thinking maybe somebody has either been through this or knows someone who has. She has horrible results due to this procedure. I'd just hate to see her depressed and beating herself up for nothing if there isn't anything she can even do anway.
Do I have a case for medical malpractice? I had a hysterectomy in the spring, no complications. At my six week checkup, my GYN said that I was healed and could resume normal activities including sex. A week later, after my husband and I had sex, my intestines came out and I had to be rushed to the hospital for emergency surgery. I was hospitalized for 5 days and now have chronic pelvic pain. Dr's commented that this is an extremely rare event but nobody will say my hysterectomy surgeon made a mistake, even though the intestine that came out looked perfect, there was no blood when it happened and there was no scars on the intestine indicating that they had been sutured in. I saw one of the top attys in our city and they said there is no proof of dr error. I have researched this and the #1 reason for this happening is poor surgical technique, there are also other reasons like obesity and diabetes, but that doesnt apply to me...my question is how can one prove malpractice if no dr will incriminate another? Please help me.
do I have case of medical malpractice against surgeon? had hair transplant surgery 20 days ago.The scar from the donor area (strip) is not flat but bulges out like a bump, detectable to the touch specially and significantly on the lover level of it.I have allot of scars where sutures where removed and big gaps of areas where is no hair growth Looks butchered. On advice of my surgeon stiches were removed 9 days after surgery.they were removed by person who has had no experience or qualifications in doing that (I was her second client and it was performed in cosmetic saloon where she is an emploee, the surgery was also performed there). She had significant problems to do it and it was very very painful when she was cutting them and pulling them.I found out after the stitches were removed that I had disolvable sutures!!Is it medicaly correct disolvable stiches to be removed by cutting and pulling from non trained person?I can prove this facts.I don't know do I have legal claim.please respond I am disturbed.
Medical malpractice help? Lost hearing 1 1/2 years ago 2 week after PA administered heavy syringing to the affected ear. ENT noted on Med records, no active bleeding at this time. Ear graphs show flat lines on the affected ear with a mountain on the unaffected ear. I cant get anyone to tell me why? Was this due to the syringing or just a freak mishap in my ear. No, I am not old, 43 years old. Do I have a malpractice case or just tough luck? I am not out to get anyone, I just want my hearing back and the doctors dont seem to have any interest in helping me. What is your suggestion?
Medical Malpractice? Please help.? My son has been having stomach problems since April. He had been to the same hospital several times for the problem. 3 times by squad. The pain was unbarable. He had the same tests done everytime. He had CAT scans, x-rays, colonoscopy, you name it he had it. They have treated him for irritable bowel syndrom, spastic colon, H-pylori, even thought he had chrons decease. The last visit to the hospital they said he had a blockage and they were just not going to feed him until it worked itself out. The pain was untolarable. He was also sepsis. They decided to cut back on his pain medicines to help him have a bowel movement. Nothing happened. He was just in horrible pain. After laying there for 13 days, no food, dying of pain they decided to do exploritory surgery. When they got in there he had a ruptured meckel's diverticulium and a paracolic abscess. I been told that if the abscess would have busted he would have died. He was already really sick. Is this a malpractice case? Let me add also, my son is 23 and now has an temp. ileostomy and had to have a very large open would due to the fact there was so much infection they could not even close the wound. Halfway through his hospital stay he had a horrible nurse that got his medicince changed. They gave him a anxity medicine that made him so delusional he checked himself out of the hospital he he was so sick and out of it they found him naked on the bathroom floor in the emergency room. He was readmitted to a different floor.
malpractice lawyer? wondering if anyone knows of a lawyer in canada that would be good to talk to about a medical malpractice case. i had a bad experience a few years ago and would like it to be validated. my intestines were perferated and leaking for days and did a bunch of damage along with destroying all my reproductive organs which were perfectly healthy. three doctors in a row claimed i was suffering from an std, the humiliation and grief that caused alone was tremendous, i have never had an std. they all just look at the previous diagnosis and ignore the pain, treating my like some cheap tramp that deserves the pain. i have asked for advice from a couple different lawyers and nobody seems to want to deal with it. is that the way it is in canada? it's not fair, i'll never be the same. there should be some kind of compensation for thier ignorance. not just dumb excuses that at my age these things aren't common so they had no reason to think that my symptoms and cries for help were valid. I feel since they took blood, pap, and pee tests they could've seen it wasn't an std. i'm not a doctor but there must have been signs of a serious infection in my blood, they never mentioned any of the results, they didn't investigate the situation individually, they just looked at the past report and agreed with thier co-worker. in the province i live in they had all these cut backs and lack of beds, closed down entire floors and hospitals, if they had room they would've been able to make some time for me. it's not i suppose the doctors faults for that, thats why every good one leaves the country. thier wage is controlled(specialists are only aloud to work a few days of the month). takes months to get anything done, the waiting lists are long, you can't get a family doctor. they shut down all the psyciatric hospitals and the patients all live on the streets. why should the people have to suffer and die to save money for who? i paid $130.00 p/m for just myself for medical, it stinks!
