Will parents need malpractice insurance? I'm just reading about the Oregon case where a child died of an illness that authorities claim could have been cured by medical treatment. Doctor perscribed antibiotics he feels are not necessary before seeing patient. Is this medical malpractice? My dad is in a rehab center after his stroke. He had a trach put in, and recently we (the family) started noticing a bad odor when he coughs, accompanied with blood in his sputum. After pointing this out to a nurse, a test was done of his sputum and two bacteria were found. My father was then put on antibiotics. Two days later, his doctor (who has seen him all of two times in the past three months) comes in and tells us that according to his professional opinion, dad does NOT have an infection, and there is no reason for him to be on the antibiotics that HE perscribed. He further went on to inform us that it is actually dangerous for dad to be on antibiotics, but that he put him on them because that was the family's wish. It never was - we simply wanted to know whether he had an infection. Today we found out we were being charged over $1500 for the drugs that we asked for (never did). Insurance does not cover this. Is this legal? What can we do? We certainly can't afford it.

When she woke up it was over 24 hours later with major surgery. spent many days in icu and missed a lot of work. The doctor made a mistake somewhere along the line. They make laws about malpractice and medical insurance, yet it seems they can charge $350.00/ hour without having to be accountable to anyone, and the Bar Association makes it harder to pass in some states to avoid competition. Does this seem ethical? Most representatives that make the laws went to law school and have a law degree. What I meant is that those people with law degrees making the laws are not regulating how lawyers can treat their clients, but are regulating how doctors treat their patients. Someone should be regulating the quality of services that lawyers provide just as a doctor's practice is regulated for the quality of medicine--if a doctor misses something, he can be sued. It should be same with lawyers not doing a good job.
Medical Malpractice- do I have a case? Or go for 2nd opinion first? Ok- in May of 2006, I had a ruptured ectopic pregnancy, which the Dr. removed surgically, along with my fallopian tube. He had gone through my previous c-section scar (2 yrs. previous), and opened it completely. Every time I went to him, I told him I felt that it was not healing correctly. He said "put powder on it". After about 5 follow up visits, I stopped going to see him. I owed $$ from the surgery (I do have insurance), and he wouldn't see me for my last follow-up unless I paid the balance in full. My scar has STILL not healed completely- it oozes, gets infected, clears up, and gets infected again. I finally made another appointment with a different Dr., but now my husband says I should see a malpractice attorney first, because the new Dr. is not going to admit that the other Dr. did something wrong. The only reason I'm even considering this is because I have a feeling that I will have to get cut open again, and then I'll have to miss work and be responsible for more med bills.

Medical Malpractice Question? In December of 2004 I went to an ER menstrual bleeding that had lasted for 16 weeks. I did not have insurance, so they gave me a student doctor so that he could practice on me while the regular doctor watched. They decided that my problem must be PCOD and I was prescribed Progesterone. The doctor told me that I had to be sure that I wanted to take it, because it is a birth control, and if I ever want to have more children I shouldn't take it. He told me at least four times before I left that I had been given a birth control to stop the bleeding. I got a two month prescription from him and I took it exactly as prescribed. In January I got pregnant and I gave birth in October. I went to a different doctor this year, and she told me that what they gave me as actually a fertility treatment that they give to women with PCOD rather than a birth control, she could not believe how bad they screwed up. I just wanted to know if I had legal grounds to sue, and if I could win. This happened at a Catholic hospital, and I had my tubes tied there also after I had my son. I ended up delivering without my regular doctor, and the doctor that delivered me was really hesitant and didn't want to tie my tubes. They stopped doing tubal ligations just two months after I had mine done.
