Medical Malpractice suit?
I was injured during a surgery to another part of my body......I have an attorney...but don't understand all the steps that are being taken through this....If you have been through a similar situation and can give me a heads up, I would really appreciate it. I am injured permantly and pain is involved.

- Didn't you say you have an attorney? If he cant answer your questions that pertain to your state, you need to find a new lawyer.
- If you have an attorney already that's a good start. First, your attorney will need to get an expert in the field involved in your situation to say that your doctor made a mistake that was well outside the standard of care. Then, he'll have to prove that the mistake caused the permanent injury and the pain you live with. Finally, they'll have to prove how that affects your life financially. Once that part is worked through (which isn't that easy) then they'll start making a demand from the doctor's insurance co. Insurance companies don't pay easily because they know that many states have passed laws making it very difficult to bring a malpractice suit. This was intended to keep frivolous lawsuits out of court, but instead makes it very difficult to bring a medical malpractice suit to trial unless you have a catastrophic injury. That means, unless they've hurt you REALLY bad or someone has died, then there's not a lot that can be done. Your attorney should help you navigate the system. On a side note, you should be getting this information from your attorney. Call and ask to speak to the paralegal helping in your case. They are usually very knowlegeable and available to answer questions. Hope that helps.
