Medical Malpractice- do I have a case? Or go for 2nd opinion first?

Ok- in May of 2006, I had a ruptured ectopic pregnancy, which the Dr. removed surgically, along with my fallopian tube. He had gone through my previous c-section scar (2 yrs. previous), and opened it completely. Every time I went to him, I told him I felt that it was not healing correctly. He said "put powder on it". After about 5 follow up visits, I stopped going to see him. I owed $$ from the surgery (I do have insurance), and he wouldn't see me for my last follow-up unless I paid the balance in full. My scar has STILL not healed completely- it oozes, gets infected, clears up, and gets infected again. I finally made another appointment with a different Dr., but now my husband says I should see a malpractice attorney first, because the new Dr. is not going to admit that the other Dr. did something wrong. The only reason I'm even considering this is because I have a feeling that I will have to get cut open again, and then I'll have to miss work and be responsible for more med bills.

  2. I highly doubt that you'd have a solid case for malpractice. In order to do so, you would have to prove, without a doubt ... that the doctor either intentionally or through negligence, caused the repeated infections that you are suffering from. It would not only be hard, but, almost impossible to do. Sorry your suffering ... go and see the other doctor. Infection is not something that can wait.
