Medical Malpractice Attorneys and Lawyers

What type of lawyer do I need?

I have been hiding from my ex-husband (stalker) for 13 years, when I took my son to the dentist a few months back someone who works there recognized the name (i guess??) and gave him my phone number, told him what kind of car I drive, and told him that I am disabled. I know the privacy act and HIPAA are on my side to protect my info...and the dentist was so rude and mean about the whole thing...I am wanting to sue her (blippin' bleep)...lol...but I cant figure out who knows the hipaa laws, it isn't medical malpractice, so if you know please help me out...thanks so much for taking the time to help me. shell

  1. a disability lawyer maybe?
  2. American Layer that goes for every penny you don't have.... You know that there is no Law in US just a bunch a Con's. Beware Now!!.
  3. I guess I would just contact any lawyer to start with. Tell them you need some info on a situation and you're unsure of who to talk to. Most lawyers have a free first consultation. I don't know that they will help you though, because "HIPAA, the Health Insurance Portability and Accountability Act of 1996, is a federal law that sets standards for health-information privacy and security and for the electronic exchange of health information. Physicians and pharmacies, as well as other health-care providers and facilities, all must follow the law to protect prescription information and medical treatments as private patient health information." That is what is stated on the website below. Unless the laws have changed, I don't think this applies to personal information such as what you have listed. She did just give out personal information and didn't really give him any medical details. Since this is a dentist though, I'm not sure. I would talk to a lawyer about what happened. I know it would royally tick me off if I was in your situation, but it's hard to say if anything can be done. I believe there are HIPAA lawyers, so if you can find one of them to consult with, that would be the best bet.
  4. Go to the attorney general of your state. Your phone company will have that number. I wouldn't even waste time with this one. Act on it immediately. It is illegal. First, I would report the dentist to your state. Go online to the license agency for your state and report the dentist. Make sure that you have the girl's name too. If she is licensed, report her while you are on the same site. Otherwise, he will have to answer for that. find a lawyer that specializes in medicine. Look up HIPPA regulations for your state as well, they may have a place to report this.
  5. Try a family law layer. The real issue is whether or not this a tort. Also, what are your damages. Hiding is one thing. Are you now required to move, seek mental help due to anxiety, etc. How have you been damaged exactly?
