What qualifies as Medical Malpractice and should I look into filing a lawsuit?
My mother fractured her skull on Jan7,08 and was in the hospital for over 2 months. She was unconscious most of that time and during got a blood infection from her pickline as well as from nurses not always using gloves. Also she still has a large bed sore on her bottom that was almost to the bone and is not healing well. I had to write a letter to the CEO of the hospital just to get the nurses to pay more attention to her. She was rarely turned and even sat in her own bowel movement for hours at a time when she was semiconscious, and had feces in her bed sore at times. She also was positive for MRSA in her lungs after getting a breathing tube. Has anyone else dealt with a situation like this and sought legal action? Is it worth it to talk to a lawyer?

- Get out the local phone directory, turn it over and call the lawyer who is advertising on the back. There's one in every community... These guys will take a suit on contingency... meaning no-win, no-fee. They will consult with you for free and let you know if you have a case.
- Most lawyers will do a free consultation so it cannot hurt to make an appointment and ask. Also this would be considered a civil suit theirefore you would be on a contingency and not pay until you feel things have been justified, and then you give the layer (for example) 30% of what you recieve
- In addition to suing, please call the licensing agency that regulates the facility she is in. They will be more then happy to do a little surprise visit. Also, please remember that every facility has a patient advocate available either in the facility of through a state/Federal agency. ALWAYS complain to the patient advocate. It is their job to protect the patient in the facilities and investigate any complaints. Do you have proof of what you are saying? Did you take photos? Did you get her to a different doctor as soon as she was released to get a current medical status and verify what you are saying? Did you ever get an acknowledgment from the CEO? Request copies of her medical records. Your mom can sign the papers to get them. Get them asap. You do not have to give a reason, you are entitled to them.
