I Have a power of attorney for health care but doctor refuses to talk to me is this medical malpratice?
The person told the doctors that i was in charge of all health care decesions. The person died because the doctors did not know all that was going on even though I ask several times to talk to him.

- No it's not medical malpractice. With the rise in malpractice suits these days, doctors have to be protective of their patients privacy. In reality, you should kinda be happy that he's being so protective, with all of the ID stealing ppl are doing. As things stand it almost takes a court order to gain access to records that aren't yours. You should consult with an attorney just to see where your rights stand. If this is not an option, talk with the head of the hospital to see if this doctor is in the wrong being that you have a POA in effect.
- Not being a lawyer, I can't say if this is medical malpractice. However, every hospital has a Patient Relations Department, or something like that, and I would immediately seek them out to issue a complaint. Be strong and fervent in your language, but don't mention lawsuits. Just firmly state that the doctor in question is abrogating the terms and letter of law of the Power of Attorney for Health Care, and you expect the Hospital to respect those terms. - If the person you have power of attorney for is still capable of making decisions about health care the doctor doesn't have to disclose information to you.
