Medical Malpractice Attorneys and Lawyers

so.... should i seek a medical lawyer?

an issue with my spinal area. had an issue where a antenna fell on my back. I have medium to severe back pain consistantly. my first two doctos had xrays done that showed back conplications aswell as neck issues. however in the while of treatment from them civillian doctors i had another high ranking military doctor step in and say im malingering and told me as well as my chain of command told me that if i see the doctor that diagnosed me with these neck and spinal issues then they would recommend me for Uniform Code of Military Justice Jail time And/or departure from my service to the United States and the U.S. Army. Now im left with feeling that if i go to the doctor again over my issues im subject to punitive actions and im left with a spine and neck issue thats unresolved. please help if possible. in information would be great!

  1. You should have went through your chain of command and if the doctor felt like they couldn't help you then they could have refereed you to a civilan doctor. I can see your point though having served in the military a solider has to go through what at times considered a lot of red tape just to get a simple anwser. You know the old hurry up and wait routine. Sounds to me like this doctor that stepped in was just having an ego trip and trying to scare you. If in your honest opinion the military doctor(s) didn't help you and your pain was unbearable to you(by the way no one can tell you how you felt but you.)and didn't make reasonable efforts to help to alliveate your pain then you should have a family member contact the Senator/Representative for your state and ask that their offices contact them on your behalf. I would ask did you first go to sick call? If so when and who did you see? This should be in your file. You may not be able to get a copy of it but the elected officals from your state can. I don't believe they will do the depart from service/jail time. I believe that is just a scare tatic. At worst you could lose some rank,some pay,or be confined to garrison for a while. I also believe that you could be transferred to another unit. If this happens then think about it that may the best thing for you and when the smoke clears I feel like that you should request a transfer. The reason being is that your chain of command may not openly harrass you but the lower ranking people can be canjoled into doing it and the people at the top won't try and stop it too badly(they will chose to ignore it unless you are in a way of being physically harmed. Then they have to step in so they can say"we did whatever" If you will go and look through history you will see where soliders(as a matter of fact a little thing like Shay's Rebellion happened because the vets got screwed around)people who have been in the military have always been considered no more better than a piece of meat. The thing about it is that you are worth more to your country as a dead hero than a hurt vet. It costs money to keep a sick person well than it does to pay for a funeral. Just think about it this unit may not be for you. Another unit maybe just what you need. It just took this to bring it to light. In the meantime while you are waiting for these things to pass over(hopefully you will have your federally elected officals contacted)keep your nose clean as much as possible(expect some harassment from those who don't have a mind of their own and listen to the dictates of others.)keep your weight in line,pass all of your tests(BRM,PT,SQD,etc)make formations on time(a good rule of thumb is to be there 5 minutes eariler)do not bad mouth anyone to anybody(it will come back to haunt you trust me on this one)speak as much as needed and give proper military courtsey to leaders and remain friendly as much as is possible. When you are dismissed don't hang around with a lot of people. Do not go drinking with anyone(they may get you drunk and send a conselour to talk with you and be able to say that you are a problem justifying their points that they make to others.) Keep your head up and be positive in all things. You may be put on the dirty job list but do it joyfully and have a good atitude about it. If and when someone makes a smart remark to you do your best to just let it go and move on. Also if you feel like you need to talk to someone go talk to the unit's catholic priest and if the post doesn't have one request for one(you may not be cathoilc but you can't be refused attending a place of worship and the priest is supposed to hold what you tell them in confidence which means that unless you give them premission- written or verbal they can't dicuss anything that you and them talk about) This has been a lot but hopefully it has helped somewhat. Also when you have your federal lawmakers contacted do so by certified mail with return receipt and make a copy of the letter and whatever letter they send you keep the enevlop it goes in and keep contacting them until the situation is solved how you want it to be and take no less than what you want. Also document who says what to you as far as harassment and keep it put up and show it to the ones you contact. Don't even let your close friends know. Let the ones you contact know about it though.
