What do i do about crappy lawyer?
I have a medical malpractice suit...it started almost 4 yrs ago, and we finally went for a case evaluation June 1st...in the letter i got, it says to talk to my lawyer about the offer before accepting it. I have until tommorow to turn my answer in, or it is automatically rejected...problem is, i have called my lawyer about 50 times over the past month, and cant get a call back...i have talked to the secretary, his paralegal, everyone i could, saying how important it is i talk to him TODAY, since its due tommorow...previously i was just told he would call back, over and over again...today, since i complained so much, they said he MIGHT be back in the office after 3 pm, so i can come sit down there and wait to see if he does...the office is about 45 minutes away, and i have a 4 yr old i would have to bring, so that option doesnt sound all too appealing, but if i have to, i have to...what should i do? Can i fire him at this point? Who do i complain to? Is this expected behavior? Thanks!

- There are overseeing agencies that monitor and take action against lawyers who flagrantly mis handle cases and clients. I would take a shot and call the secretary at the office and tell her that if you dont hear from him today you have documented all of the attempts to contact him and that his failure to respond is going to have serious consequences. Then say you are going to report the lawyer to the bar association on Monday. I guarantee you will get a call.
- I've had a similar experience with a lawyer. They promise you everything under the sun to get your money. Once they have it, it's like they couldn't care less about your case. They are smart enough to know that most people have too much time, emotion, and money invested in them once a case gets that far to fire them. I would look over the answer with a trusted friend, give them an answer on your own, then start your second malpractice suit against the lawyer.
