why my lawyer has to subpoena my medical records? it is a workers comp case?

I had an accident at work nd ended up having surgery. I work for 8 more places, and I do not know if I am going to have work back in those places. Should I get another lawyer?

  1. To check and make sure you don't have a history of the injury you sustained. They're probably trying to prove that the injury originally happened at your place of employment, not that you just aggravated a previous injury at work.
  2. Because in order to win a workers comp case, you have to prove that you were injured on the job, how are you going to do this with no medical proof?? I would let your lawyer do their job.
  3. They are looking to make sure you aren't committing fraud. Many people who are injured use the system to their advantage, hence the stricter laws that have come out regarding workers comp. Don't worry - if you're legit, you're in the clear.
  4. If it's a workers comp case, the lawyer needs to see if there are any pre-existing issues that could have contributed to your injury.
  5. Uh.. there is this thing called EVIDENCE which is normally a big part of a court case. Drs will not just give the records out by request, so there has to be a court order. If you show up in court without evidence, you will be laughed out the door. I sure hope you don't get another lawyer, who does not want the records.. you'll lose the whole thing.
