I need a lawyer to sue this Dr. here in Fremont,who gave me a Medical and Physical Exam w/o wearing gloves?
i don't know what kind of lawyer to get to sue this Dr. who gave me Medical and Physical exam,he never wear any gloves while doing this exam on me,i might get infected by his malpractice and other patients too.Pls Suggest what kind of lawyer to get.Email me at "gbf2872@yahoo.com" for your help

- if he didnt touch in your vagina, anus, eyes or mouth then you are fine. doctors dont have to wear gloves unless they are doing a pap.
- It is not a very good idea to give your e mail address on here, not everyone is honest! Get advice from a family centre or advice bureau.
- Actually, it is not illegal to not wear gloves, only unsanitary and dangerous. You need to let your doctor know or anyone for that matter who is performing a medical procedure on you that you want them to wear gloves or not to touch you. Many people who have been in the medical field a long time think that gloves are not necessary or that they get in the way, but they are at risk of transmitting an infection to you, to other patients and to themselves and their family! Shame on that doctor!
- "Might get infected" doesn't constitute malpractice. I doubt you could successfully bring suit against the doctor. Most lawyers are probably going to laugh at you. That's like slapping a lawsuit on McDonald's because you "might get food poisoning". It hasn't happened so you can't do it. Maybe you should find another doctor, or report him to the American Medical Association or health inspectors. Better yet, you need to find another hobby than trying to get free money out of people.
- Why didn't you just ask him to wear gloves at the time? Why are people so sue-happy? Everyone wants to retro-act instead of actually act.
- I usually don't wear gloves when I give women exams...although I'm not a doctor...I only stayed in a Holiday Inn Express. Did you ask him to wear gloves??? If you did and he declined, you should have left!!!
- Seriously? Are you serious? Did you tell him that you wanted him to wear gloves??? People will sue for any reason nowadays! Get a life!

- You can only sue for malpractice if you suffered harm/damage. You cant sue a doctor for what he MIGHT have done. It's impossible. Example: If he gave you the wrong medication, but nothing happened and you are fine....no harm.... If he gave you the wrong medication, and you have a stroke or a heart attack, you have a claim against him. 'Nuff said
- Where I work you wouldn't be able to sue someone for "might have happened" situations. Of course were pretty high on the totem pole and were not a sleazy law firm. If you really want to pursue this which I don't think that they would actually take your case and they would probably have you pay upfront cost I would go to a Personal Injury Lawyer that was just starting out or if you can find a sleazy attorneys office there is one right across our office ha ha. I wouldn't pursue it if I were you as far as suing goes, but I think that you should maybe contact the hospital director and let them know whats going on.
- In order to prove malpractice, there generally have to be three elements. 1) a error in medical practice 2) an injury (ex., an infection) 3) proof that #1 caused #2.
- did you ask him to put gloves on? did he wash his hands. My Dr never uses gloves unless i have an open cut or something like that but he washes his hands every time he comes in the room and every time he leaves with an anti bacterial soap that is sitting on the counter in every exam room. I have seen many Dr's and most dont use gloves because the wash there hands in frount of your. If you wanted the Dr to use gloves you should have told him to put them on and at that point if he did not then you could have left nothing made you stay.
- if you had a problem with it you should have said something.... and Dr's wash their hands... A LOT.... if it was really an issue you should have had the balls to say something...stop whining and looking for a way to take advantage of someone....
