Do Wrongful Death and Malpractice Attorneys have Medical Knowledge?

  1. They are very bright. . .if they don't they know where to get the resources to answer their inquiries.
  2. Lawyers usually rely on doctors and others for advice in wrongful death suits.
  3. some do but some don't! they usually depend on a doctor to determine if it would be a wrongful death or Malpractice!
  4. possibly, however they rely on doctors whose employed by the law firm, and that is the doctors only job.
  5. No idea ,but I'm sure they have access to sound medical information. Otherwise they'd be fools to take a case on, and we all know lawyers don't take cases they can't win unless they have an idiot for a client who's gonna pay them no matter what happens.
  6. No, they call expert witnesses, but they will talk about their previous casework and tell you how that shook out.
  7. They have some basic knowledge, but will have experts review the medical reports.
  8. From personal experience I can tell you that many malpractice attorneys are former physicians. When I had a reason to consult them two of the four attorneys in the practice had been physicians. Always wondered - too much or not enough knowledge, but they did seem both knowing and practical.
  9. There are a few medical doctors with law degrees who specialize in the area. I think most work as expert witnesses. Otherwise, med mal attorneys have a list of regular expert witnesses and they call the one or two most likely to be of help in pursuing a particular case.
  10. The more they sue companies the more they learn but when it comes to a trial they will use a doctor as an expert. It does not matter what you know but only what you can substantiate.
  11. Those who are successful have. But mostly limited to area where errors are made. ..and then, of ocurse, the do furhter research on the issues. But then, their job is to represent their client; so if a doctor does wrong, they will obtain testimony that he was right. more questions?
